A lawsuit filed on September 17, 2026 in Tehama County Superior Court by a client of Lanier Meyer McBride Blair LLP alleges that Corning Union High School District failed to protect a student at Corning Union High School from sexual abuse by summer school teacher David Tinker. The complaint alleges the district allowed the teacher secluded, unsupervised access to students during a summer session when the campus was understaffed, largely empty and mostly unsupervised, and failed to provide the level of supervision provided during the regular school year. The complaint states the teacher is believed to have died, and he is not named as a defendant.

What the complaint alleges

“Specifically, based upon information and therefore belief, TINKER was allowed to have secluded access to minors during summer school, the summer school campus itself was understaffed, largely empty and mostly unsupervised, and TINKER was enabled unsupervised access to the Plaintiff and potentially other minor students without supervision.”

(Complaint ¶ 26)

“The Defendant DISTRICT knew, or easily could have discovered with minimal supervision, that TINKER was engaging in sexual misconduct with minor students, and, furthermore, that the DISTRICT did, or should have, documented and reported these clear warning signs.”
